Understanding Avanir’s Payments to Healthcare Professionals and Healthcare Organizations

Avanir’s mission is to deliver innovative CNS solutions to improve the lives of patients and their care communities. An aspect of delivering on that mission involves Avanir’s collaboration with experienced Healthcare Professionals (HCP) and Healthcare Organizations (HCO). Avanir engages HCPs and HCOs in several ways, including gaining insights and seeking expertise through advisory boards or consulting services, providing education through medical education programs and in-office information exchanges, engaging qualified HCPs as speakers, conducting speaker programs, and collaborating with scientific leaders and organizations within our clinical research and development programs. 

Avanir has a rigorous screening process for determining whom to work with and expects that all engagements be conducted with integrity, adhere to the highest ethical standards, and comply with all applicable laws and federal healthcare program requirements. HCPs and HCOs are appropriately compensated for their expertise, guidance, and feedback in providing services to Avanir. Avanir does not pay HCPs or HCOs for prescribing its medications or as an incentive or reward to influence independent medical decision making or referral decisions. 

Avanir believes that transparency around its financial relationships with HCPs and HCOs is of critical importance. Below is a summary of the forms and natures of payment Avanir makes to certain HCPs and HCOs covered under federal reporting laws and instructions on how to access further information on those payments. 

Who are Covered Recipients? 

Avanir is required by a law known as the Sunshine Act to report annually to the Centers for Medicare & Medicaid Services (“CMS”) any transfers of value to HCPs and HCOs who qualify as Covered Recipients1, including: 

  • Physicians, except for any physician who is a bona fide employee of Avanir
  • Teaching hospitals that receive payment during the last calendar year for which such information is available, for Medicare direct graduate medical education (GME), inpatient prospective payment system (IPPS) indirect medical education (IME), or psychiatric hospital IME programs. 

Forms of Payment Made

Avanir appropriately compensates Covered Recipients for the services provided. Forms of payment may include cash or cash equivalent and/or in-kind items or services.

Natures of Payment Reported

The Natures of Payment2 made by Avanir in connection with arrangements with Covered Recipients generally fall into the categories listed below. To see the actual payments and their types made by Avanir to Covered Recipients, please follow instructions provided in the section below:

  • Consulting fee
  • Compensation for services other than consulting, including serving as faculty or as a speaker at an event other than a continuing education program
  • Honoraria
  • Food and beverage
  • Travel and lodging (including the specified destinations)
  • Education
  • Research
  • Charitable contribution
  • Royalty or license
  • Current or prospective ownership or investment interest
  • Compensation for serving as faculty or as a speaker for an unaccredited and non-certified continuing education program
  • Compensation for serving as faculty or as a speaker for an accredited or certified continuing education program
  • Grant
  • Space rental or facility fees (teaching hospital only)

CMS displays the data collected from Avanir and other applicable manufacturers on the Open Payments website. Below are instructions on how to use the Open Payments website, if you would like to search for payments Avanir has made to Covered Recipients. 

How to Utilize the CMS Open Payments Data Search Tool 

CMS’ Open Payments Data website provides users with resources to aid in the use of the website. Visitors to the site may download Open Payments datasets, build a query, or utilize the Search Tool to view reported payments made by companies to Physicians or Teaching Hospitals.

  • To search from the Open Payments home page:
    • Enter a First Name, Last Name, Teaching Hospital Name or Company Name in the search bar. Results will begin to display once matches are identified.
    • When the results screen appears, click on the Physician Name, Teaching Hospital or Company you wish to review.
    • If there are more than 10 matching records, only the first 10 records will display. Click through additional record pages to view all available records. Click on the blue name link for the profile you wish to view. 
    • A profile screen will display summary-level information for the most recently published reporting year. 
      • Profile data for previous reporting years can be viewed by selecting the “Select a year for which you want to view data” drop down. 
      • A breakdown by “Payment Type” can be viewed by clicking through the different Payment Type tabs (e.g., General Payments, Research Payments or Ownership and Investment Interest). 
    • If desired, use the Search Tool to search by additional criteria.
  • To search using the Search Tool:
    • Choose the appropriate option for “Physician”, “Teaching Hospital” or “Company Making Payments”.
    • Enter information in the search boxes and click “Search” when ready.
    • On the results screen, click on the blue name link for the profile you wish to view. 
    • A profile screen will display summary-level information for the most recently published reporting year. 
      • Profile data for previous Reporting Years can be viewed by selecting the “Select a year for which you want to view data” drop down. 
      • A breakdown by “Payment Type” can be viewed by clicking through the different Payment Type tabs (e.g., General Payments, Research Payments or Ownership and Investment Interest).
